The following terms and conditions relate to participation in personal training services provided by Xander Brice Coaching.
1. Assumption of Risk
I understand that participation in personal training, strength and conditioning programs, and any related physical activities involves inherent risks. These activities include, but are not limited to, Olympic weightlifting, gymnastics, CrossFit, cardiovascular training, and other exercises that may involve strenuous exertion, movements, and the use of equipment, which can result in physical injury or discomfort.
I acknowledge that I am voluntarily participating in these activities and assume all risks, including but not limited to muscle strains, sprains, injury, or health complications.
2. Medical Clearance
I confirm that I am in good health and physically able to participate in the fitness programs offered by Xander Brice Coaching. I understand that it is my responsibility to consult with a physician prior to starting any exercise program. If I have any medical conditions, injuries, or concerns, I have discussed these with my physician and have been cleared to participate.
I further agree to inform Xander Brice Coaching of any changes in my health, injuries, or conditions that may affect my ability to participate.
3. Release of Liability
In consideration of being allowed to participate in training sessions, I hereby release, waive, discharge, and hold harmless Xander Brice Coaching, its coaches, agents, employees, and contractors from any and all claims, liabilities, or causes of action that may arise from my participation in the fitness programs.
This includes, but is not limited to, injury, death, or property damage caused by the negligence of Xander Brice Coaching or others associated with the services provided. I understand that I am waiving my right to bring legal claims or lawsuits for damages or injuries incurred during participation.
4. Indemnification
I agree to indemnify and hold harmless Xander Brice Coaching from any claims, damages, or costs (including legal fees) that may arise as a result of my participation in the training programs or as a result of my own negligence or misconduct.
5. Photographs and Media Release
I grant Xander Brice Coaching the right to use photographs, videos, or other media that may include my image or likeness during training sessions for promotional purposes, including on websites and social media platforms, without compensation or further consent.
6. Cancellations and Refunds
I understand that sessions must be canceled at least 24 hours in advance to avoid charges. Failure to do so will result in the full session fee being charged. Refunds for prepaid sessions will be considered on a case-by-case basis and at the discretion of Xander Brice Coaching.
7. Acknowledgment of Understanding
I have read this waiver and fully understand its terms. I acknowledge that I am signing it freely and voluntarily, and intend for it to be a complete and unconditional release of all liability to the greatest extent allowed by law.
